The terms of this website.
The rules that apply when you use the Breakwater website, read the readings and register we publish, or send us a site study request.
Example text for the Breakwater template, written for a fictional company (Breakwater, Nantes, France). This is an example to be reviewed by a lawyer: adapt it to your company, your tools and your country before you publish.
1. About these terms
This website is run by Breakwater, a climate adaptation company based in Nantes, France. By using it, you accept these terms. If you do not accept them, please do not use the website.
2. Using the website
You may browse the website, read and share its pages for your own information and for the work of your organisation.
You may not try to disrupt the website, access parts of it that are not public, collect its content automatically in a way that overloads it, or use it for any unlawful purpose.
3. Readings, figures and the register
The readings, figures and register entries on this website describe our sites and are published for information. Each one carries a date, a source and a status (measured, reported or verified). Modelled figures are labelled as modelled.
The readings shown on this website are not a flood warning service. For warnings and emergency instructions, follow your national and local authorities.
4. Site study requests
Sending a site study request does not create a contract. A first hindcast, design options and prices are proposals. A contract exists only once both parties have signed a written agreement, which then takes precedence over these terms.
5. Intellectual property
The text, photographs, drawings, logo and layout of this website belong to Breakwater or to their authors, and are protected by intellectual property law. You may quote short extracts with a clear reference to the source. Any other reuse needs our written permission.
Data published under an open data licence named in a public contract follows the terms of that licence.
6. Links to other websites
This website may link to websites we do not control, such as public authorities or partners. We are not responsible for their content or for how they handle your data.
7. Liability
We take care to keep this website accurate and available, but we cannot guarantee that it is free of errors or always online. To the extent allowed by law, Breakwater is not liable for indirect loss arising from the use of this website or from decisions taken on the basis of its content alone.
Nothing in these terms limits liability that cannot be limited by law.
8. Governing law
These terms are governed by French law. If a dispute arises, we will first try to settle it amicably. Failing that, the courts of Nantes have jurisdiction, subject to any mandatory rule that gives you the right to go to another court.
9. Changes and contact
We may update these terms. The date at the top of the page shows the latest version. For any question, use the form on our contact page.
